In consideration of permission to use, today and on all future dates, the services of bulldog online, LLC, a Delaware limited liability company (d/b/a “bulldog yoga”), and to participate in yoga, cardiovascular training, and other physical activities (collectively, the “Program”), Participant on behalf of himself/herself, his/her heirs, personal representatives, and assigns, does hereby release, waive, and discharge bulldog yoga, together with its affiliates, officers, managers, members, partners, employees, volunteers, independent contractors, and agents (collectively, the “Released Parties”) from liability in connection with any and all claims arising from Participant’s own negligence or actions, the negligence or actions of others, or the Released Parties’ negligence relating to participation in the Program. This Liability Release and Waiver applies to personal injury (including death) from accidents or illnesses arising from the participation in physical activities including, but not limited to, participation in and/or observation of online classes involving the Program. Participant understands that yoga and other activities offered by bulldog yoga are not substitutes for medical attention, examination, diagnosis or treatment. By signing this waiver, Participant certifies to the Released Parties that (i) he/she has been advised to consult a physician prior to commencement of the Program to ensure his/her state of wellness to participate in such strenuous activities; (ii) he/she is in good health to participate in, and knows of no medical problem that would increase his or her risk of illness and injury as a result of participating in, the Program; and (iii) he/she is responsible for assessing whether any physical activities exceed his/her physical capabilities. Participant agrees to indemnify, defend and hold the Released Parties harmless from and against any claim, demand, cause of action, liability, damage, loss or expense (including attorneys’ fees and litigation/arbitration costs) arising from, whether in whole or in part, directly or indirectly, the participation in the Program by Participant.
